I/We have read, understood and agree to abide by these Terms including any changes there to made by Bealert in its sole discretion, from time to time, relating to my Transaction with Bealert, which changes shall be made available on Bealert's website/s (www.bealert.info and Mobile application). I/We agree that the Terms form a valid contract between myself/ourselves and Bealert, and that Bealert may, at its sole discretion, amend the Services relating to the Transaction and/or the Terms, either wholly or partially, at any time in the manner stated above and without the requirement of any prior notice or consent.

I/We agree that these Terms constitute the entire agreement between myself/ourselves and Bealert with respect to the Transaction and these Terms supersede all prior or contemporaneous communications and proposals, if any, whether electronic, oral, or written, between me/us and Bealert with respect to the Transaction. A printed version of these Terms and of any notice given in electronic form shall be valid and admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as any other documents and records originally generated and maintained in printed form.

I/We agree and understand that any and all information contained in the website & mobile application Services has been based on the information provided by its various uploaders. The uploader is an individual Consequently, Bealert shall not be responsible for the accuracy, completeness, and veracity of any and all such information as provided by uploader. I/We also understand that the information is current and up to date to such extent as provided by the uploader and is subject to changes and amendments made thereafter and that any information contained herein does not reflect the views of Bealert or Proprietor or partner or its directors or employees. Also, Bealert shall incur no liability and shall not be required to indemnify me/us for any loss, damages, defamation, claims or expenses incurred by me/us for any incorrect information provided due to incorrect information and/or documents provided by me/us or if for any technical reason, any incorrect report is provided otherwise. If an Uploader is a member of any types of association, or Any Agency or Groups or else that association or agency or group are also not liable for the genuineness of the information or documents uploaded by the Uploader. If any uploaded case information is found to be inaccurate at any time, neither Bealert nor the association shall be held liable. On this Website, Bealert acts solely as an intermediary. The genuineness of the information is the sole responsibility of the Uploader, and Bealert makes no representations or warranties regarding its accuracy. Users are advised to independently verify any information found on the Website before relying upon it.

I/We understand and agree that Bealert shall not be required to seek prior permission from me/us for updating information that may be reported to Bealert by the Members or otherwise come to the information of Bealert and Bealert shall not be responsible to verify the correctness of the information received hereby. Bealert shall reproduce the information submitted to it by its Members on “as is” basis.

Bealert shall have the right to terminate provision of the Services or any part thereof, at its sole discretion at any time. Further, not with standing the Terms contained herein, Bealert reserves the right to reject my Request Former registration or uploaded Document or mentioned information of my and default person or any of persons made due to any reason whatsoever and shall not be required to specify such reason for rejecting the same.

Bealert reserves the right to initiate legal proceedings including criminal proceedings against the perpetrators of fraud, money laundering or any other form of wrong doing in relation to the Services. I/We have read in full and have completely understood the steps to access Services offered by Bealert.

Bealert reserves the right to change any of the terms, conditions, and notices under which "The Service" is offered. You are responsible for regularly reviewing these terms of use including changes/modifications if any incorporated by us from time to time. Your continued use of 'The Service' constitutes your Agreement to all such terms, conditions and notices.

Bealert reserves the right to Terminate/modify or discontinue, temporarily or permanently, ‘The Service’ (or any part of 'The Service') with or without notice to the user or member or uploader at any time and from time to time. 'The User or member or uploader' agrees that our website and mobile application shall not be liable to the User or member or uploader' any third-party for any modification or discontinuance of the Service.

Subject to the terms and conditions of this Agreement, Bealert hereby grants you a limited, revocable, non-transferable and non-exclusive license to access and use this website. Once you register yourself with our website you will get information updates via email or through any other communication mode on a day-to-day basis. Users or uploaders need to register him/her self and need to create the login id and password. The uploader can upload the genuine information using our portal. The uploader will not upload or misleading information to defame the other person or entity. If at any stage Bealert finds that those uploaded information are incorrect in that case Bealert reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation. You shall not upload via your testimonial, distribute, or otherwise publish through this website any of the Content, information, or other material that –

(a) Violates or infringes the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person;

(b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under Indian law; or

(c) includes any bugs, viruses, worms, trap doors, Trojan horses or other harmful code or properties; or

(d) criminal or tortious activity, including pornography, child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets; or

(e) Using any information obtained from the website in order to harass, abuse, or harm another person;

Our fees will be different and based on the services provided by us. The detailed information of the fees and currency will be provided to users when they subscribe for specific services. Once fees are paid it will not be refunded. I/We understand that a payment of the stipulated charges for Services may be made through my/our Net Banking channel. I/We agree to pay such an amount as stipulated by Bealert for any services. The charges are inclusive of delivery charges, payment gateway charges (if any) and all applicable other taxes. Bealert shall not be liable in any manner what so ever for any fraud that may be committed on my/our net banking account or my Credit Card/Debit Card, as the case may be, whether due to loss or theft or otherwise.

Under Rule 3 of Rules made under IT Act, 2000 vide powers conferred by clause (zg) of sub¬section (2) of section 87 read with sub-section (2) of section 79 :

Users of computer resource not to host, display, upload, modify, publish, transmit, update or share any information that —

(a) belongs to another person and to which the user does not have any right to;

(b) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

(c) Harm minors in any way;

(d) Infringes any patent, trademark, copyright or other proprietary rights;

(e) Violates any law for the time being in force;

(f) Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

(g) Impersonate another person;

(h) Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

(i) Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

As a condition of your use of "The Service" you, 'The User' or Member or Uploader’s agree to provide:

(a) True, accurate, current and complete information about yourself as required while registering yourself.

(b) Maintain and promptly update the Registration Information to keep it accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, Bealert has the right to terminate the User or Member or Uploader account and refuse any and all current or future use of 'The Service' any time.

(c) When uploading financial information, including details about companies which includes partnership firm, proprietorship firm, trust, organisation, group’s, H.U.F or anyone also director or partner or employee or anyone else of company’s, partnership firm, proprietorship firm, trust, organisation, group’s, H.U.F or anyone or individuals, who have issued cheques (which are dishonoured), or (not given cheque) and given promise to full fill payment of due amount of bills/invoices or else or any type of due amount of any reasons or promises and not to paid partnership firm, proprietorship firm, trust, organisation, group, H.U.F or anyone, individuals who have failed to pay dues, GST or VAT detail, photos of defaulters, invoices, Bank detail, Cheque Detail, Cheque photos, Address, mobile or land line numbers, email, Any type of additional informative Notes and anything else and etc., you are solely responsible for ensuring the accuracy of the information provided about the partnership firm, proprietorship firm, trust, organisation, group, H.U.F or anyone individual or company. As an intermediary, we (bealert) can not verify the information uploaded by an uploader. Uploader needs to upload PAN card details of the defaulters.

(d) You will create, maintain and use only one Member account and password on the website for your use. You will not create multiple Member accounts and passwords for your use on the website.

(a) Obstruct or hinder the use of "The Service" by other Users;

(b) Intentionally or unintentionally violate any applicable local, state, national, and international laws and regulations;

(c) Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(d) Interfere with or disrupt the Service or servers or networks connected to the Service, or challenge any requirements, regulations or guidelines of networks connected to "The Service";

(e) Transmit or otherwise make available any material in connection with surveys, chain letters, junk email, spamming, contests, pyramid schemes, or any duplicative or unsolicited messages (commercial or otherwise);

(f) Upload, post, email, transmit or otherwise make available any content that is unlawful, damaging, intimidating, hostile, offensive, harassing, defamatory, improper, obscene, vulgar, invasive of another's privacy, caste related, ethnically or otherwise objectionable;

(g) Upload, post, email, transmit or otherwise make available any content protected by any patent, trademark, copyright or other intellectual proprietary laws unless you own or control the rights thereto or have received all necessary consents to do the same;

(h) Upload files that contain viruses, worms, corrupted files or any other similar software or programs designed to disrupt, damage or limit the operation of any computer or telecommunications equipment or property of another;

(i) "Stalk" or otherwise harass other users; collect or store personal data about other users.

(j) Advertise, Promote or offer to sell or buy any goods or services for any business purpose unless The Service specifically allows such messages or transactions.

(k) Reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion, use or access of the Service.

(l) Harm minors in any way;

(m) Upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships;

(n) Uploader can not upload misleading and incorrect information about the defaulter to defame him/her.

In view of the global nature of the world wide web, the User or Member or Uploader understands and agrees that technical processing of tools of communication is (and may be) required to send and receive messages, to correspond / conform to the technical requirements of connecting networks, to correspond / conform to the limitations of The Service, or to correspond / conform to other, similar technical requirements.

As part of The Service's registration process, User or Member or Uploader will provide us with current, complete and accurate information as requested at the time of registration process. User or Member or Uploader will then choose a username and password. User or Member or Uploader take total responsibility for maintaining the confidentiality of your password and account. User or Member or Uploader may change your password by following the instructions on the system. User or Member or Uploader agree not to use the account or password of another Member at any time or to disclose your password to any third party. However, User or Member or Uploader could be held liable for losses or damages incurred by us or a third party as a result of your failure to comply with this clause. User or Member or Uploader also agree not to use anyone else's account, at any time, without the prior permission of the account holder.

Use of the www.bealert.info Services is also governed by Our Privacy Policy, which is incorporated into this Agreement by this reference. For more information, see our Privacy Policy on the website Privacy Policy.

The features and services on the website are provided on an "as is" and "as available" basis, and bealert hereby expressly disclaim any and all warranties, express or implied, including but not limited to any warranties of condition, quality, durability, performance, accuracy, reliability, merchantability for a particular purpose.

Our website and mobile application is not responsible for any error, omission, interruption, loss, deletion, defect, theft, destruction or unauthorized access to, or alteration of any content User or Member or Uploader upload on our website. Website will not be responsible for any incorrect or inaccurate content uploaded on the website or in connection with the website services.

This platform serves as an intermediary for the dissemination of information regarding bounced cheques or due amount of any, including entities and individuals associated with such instances. Bealert expressly disclaim any warranty or guarantee regarding the accuracy, completeness, or reliability of the information uploaded by Uploader. Bealert is not responsible for independently verifying the veracity of any data submitted through this platform.

'The User or Member or Uploader are solely responsible for the accuracy and truthfulness of the information they upload and shall indemnify and hold harmless this website/platform and its affiliates from any and all claims, liabilities, damages, and expenses arising from any inaccuracies, errors, or misrepresentations in the uploaded data.

I/We agree that I/we shall not hold Bealert liable or responsible for non-availability of its Website either due to internet connectivity speeds or errors on my/our computer or during periodic maintenance operations or any unplanned suspension of access to the Website that may occur due to technical reasons or for any reason beyond Bealert’s control.

All conditions, terms, representations and warranties relating to the website services supplied under this Agreement, whether imposed by statute or operation of law or otherwise, that are not expressly stated in these terms and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded to the extent applicable under Indian laws. Our website only provides a platform/medium for communication, networking between the User or Member or Uploader and service providers.

Bealert does not claim ownership of the "content" (in the form of information, data, Invoices/bills, Pan Card Details, Aadhaar Card Details, G.S.T or V.A.T Detail, Cheque Detail, Photo of the defaulter, text, names, notes, bank account details, or if any) or service for review by the User or Member or Uploader. The ownership of this content is the sole responsibility of the person from which such content originated and uploaded. This means that the owner of the content is the concern department to whom that content belongs and not the Bealert. Bealert is just an intermediary who provides collective services to the User or Member or Uploader.

All content and material that is made available to view and/or download in connection with the Service, excluding content that may be made available by the User or Member or Uploader or visitors through the Service. We do not endorse and have no control over the Content. Content is not necessarily reviewed by us.

You may not allocate, distribute, or reproduce in any way any copyrighted material, Designs, trademarks or other Intellectual proprietary Information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of our website to terminate Membership privileges of any Member who once infringes the copyright rights of others upon receipt of prompt notification to Bealert by the copyright owner or the copyright owner's legal agent/Advisor.

You are granted a non-exclusive, non-transferable, revocable license to access and use our website strictly in accordance with these terms and conditions. As a condition of your use of the website, bealert warrant to us, that you will not use the website for any purpose that is unlawful or prohibited by these Terms. You may not use the website in any manner which could damage, disable, overburden, or impair the website or interfere with any other party’s use and enjoyment of the website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the website.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the website, is the property of owner of this website i.e. Bealert or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. If you access the Service from a location outside India, you are responsible for compliance with all local laws. You agree that you will not use our website Content accessed through www.bealert.info in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

You "The User or Member or Uploader comprehend and agree to indemnify and hold us and its parents, affiliates, trustees, officers and employees, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of your use of the Service, your connection to the Service, your violation of the website Agreement or any other provision of the Agreement, or the infringement or misappropriation by the User or Member or Uploader, or a third party using User or Member or Uploader's computer, account or password to access and/or use the services, of any Intellectual Property Rights of any person or entity, or the use or misuse by the User or Member or Uploader or third parties of User's passwords or accounts, or your violation of any rights of another.

This Agreement shall remain in full force and effect while you use our website Services or are a registered User or Member or Uploader. Even after Membership is terminated, this Agreement will remain in effect. However, we reserve the right to terminate access to certain areas or features of the website (to paying or registered users) at any time for any reason, with or without notice. Our website with holds the right to temporary or permanent termination of membership of any user or Member or Uploader for any of the following reasons:

(d) Post any material to members that are not related to international trade or business cooperation.

(e) Impersonate or unlawfully use another company’s name to upload false information in any form.

(f) Any unauthorized access, use, modification, or control of the website database, network or related services.

(g) Obtain by any means a website member's user name and/or password. If our website terminates user(s) membership, user(s) will not have the right to re-enroll or join us under a new account or name unless formally invited to do so by us.

(h) If you provided misinformation about the individual or companies or any third person.

Bealert may contain links to third party Websites "Linked Sites" ("Affiliates" / "Partner Sites"). These Linked Sites are not under the control of our website and Bealert is not responsible for the products of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site.

These Terms are governed by and are subject to Indian laws.

In the event of any claim, dispute or difference arising out of or in relation to these Terms, the claim, dispute or difference shall be referred to arbitration to be conducted by a sole arbitrator to be appointed by Bealert who shall be the presiding arbitrator and the decisions and award of the arbitral tribunal shall be final and binding. The arbitration proceedings shall be held in Ahmedabad, Gujarat. and shall be conducted in the English or Gujarati language and be governed by the provisions of Arbitration and Conciliation Act, 1996 and any modification or re-enactment thereof in force at the relevant time. All costs of such arbitration shall be borne by the User or Uploader or member.

Subject to what is stated above, any matters which may require the intervention or any determination by a Court, including any appointment of any arbitrators under Section 11 of the Arbitration and Conciliation Act, 1996, whether prior to, or during or after the aforesaid arbitration, shall be subject to the exclusive jurisdiction of the Courts in Ahmedabad, Gujarat.

Any forbearance or failure by bealert to enforce a provision to which you are subject shall not affect our right to require such performance at any subsequent time, nor shall the waiver or forbearance by bealert of any breach of any provisions of the agreement herein be taken to be or held to be a waiver of the provision or provisions itself of themselves.

No right may be assigned, and no duty may be delegated, by either party under this Agreement except upon the written consent of the other party and any attempted assignment and delegation without such consent shall be void and without effect. Notwithstanding the foregoing, however, Bealert shall be entitled to assign this agreement, and all rights and obligations hereunder, to a successor to all or substantially all of its assets, whether by sale, merger or otherwise. This Agreement shall be binding upon and shall insure to the benefit of the parties hereto and their respective representatives, heirs, administrators, successors and permitted assigns except as otherwise provided herein.

Neither party is, nor will it be deemed to be, an agent or legal representative of the other party for any purpose. Neither party will be entitled to enter into any contracts in the name of or on behalf of the other party, nor will neither party be entitled to pledge the credit of the other party in any way or hold itself out as having authority to do so.

If any provision(s) of the Agreement is/are held by a court of competent jurisdiction to be contrary to law, or otherwise invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

I/We agree to defend, indemnify, and hold harmless Bealert, its officers, directors, employees, agents, licensees, affiliates, advisors, successors and assigns from and against any and all loss, damage, liability, claim, demand, suit, cost and expense (including court costs and reasonable attorney fees) suffered and/or incurred (as the case maybe) by Bealert and/or resulting from: (i) breach by me/us of any these Terms; (ii) claims made against Bealert by third parties including any Defaulter or any other institution arising pursuant to the provision of services with respect to the Transaction and/or any matters incidental thereto.

Bealert shall not be liable for any failure to perform any of its obligations under these Terms or provide Services or any part thereof if the performance is prevented, hindered or delayed by a Force Majeure Event (defined below) and in such case its obligations shall be suspended for so long as the Force Majeure Event continues.

Force Majeure Event means any event due to any cause beyond the reasonable control of any Party, including, without limitation, unavailability of any communication system, pandemic, breach or virus in the systems, fire, flood, explosion, acts of God, civil commotion, riots, insurrection, war, acts of government or acts of third party/ies.

bealert reserve the right, in its sole discretion, to change the Terms under which www. bealert.info & Mobile Application is offered. The most current version of the Terms will supersede all previous versions. Our website encourages you to periodically review the Terms to stay informed of our updates.

User and our website agree that any cause of action arising out of or related to these Services must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. If you do not agree with any of our Terms of Uses mentioned above please do not read the material on any of our pages or do not accept our services.

These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between Us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between Us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to this Agreement, you confirm that you have not relied on any representation other than those expressly stated in this Agreement and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.
